To the fullest extent permitted by law, Benefits Command, LLC and its owners, officers, managers, employees, contractors, agents, affiliates, partners, vendors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, loss of goodwill, emotional distress, or other intangible losses.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms, our website, our communications, or our services will not exceed the amount you paid to Benefits Command in the six months before the claim arose, or $1,000, whichever is less.

We may suspend, restrict, or terminate your access at any time if we believe you violated these Terms, failed to pay amounts owed, misused our services, created risk for Benefits Command, or acted unlawfully.
Termination does not relieve you of payment obligations incurred before termination.
The sections of these Terms that by their nature should survive termination will survive, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.
26. Governing Law
These Terms and your use of our website and services are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Before filing a claim, you agree to first contact Benefits Command at [email protected] and attempt to resolve the dispute informally.
If the dispute cannot be resolved informally, the parties agree that any dispute, claim, or controversy arising out of or relating to these Terms, our website, our communications, or our services will be resolved through binding arbitration in Travis County, Texas, unless applicable law requires otherwise.
You understand that arbitration means you are waiving the right to a trial in court and the right to a jury trial.
The arbitration will be conducted on an individual basis only. To the fullest extent permitted by law, you agree that disputes may not be brought as a class action, collective action, private attorney general action, or representative action.
Nothing in this section prevents either party from seeking injunctive or equitable relief for misuse of intellectual property, unauthorized access, data misuse, confidentiality violations, or other urgent harm.
28. California Users and Residents
If you are a California resident and a complaint with us is not resolved satisfactorily, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.

30. Miscellaneous
These Terms, together with our Privacy Policy and any applicable written agreement, checkout terms, offer terms, or program terms, constitute the entire agreement between you and Benefits Command regarding your use of our website and services.
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable, and the remaining provisions will remain in full force and effect.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations at any time.
